This Terms of Use agreement (“Agreement”) governs your access to and use of the Showboat platform (“Platform”), including our mobile application and website. 1. ACCEPTANCE OF TERMS

By accessing or using Showboat, you enter into a legally binding agreement with SHOWBOAT SPORTS LIMITED (“we,” “us,” or “our”). If you do not agree with any part of these terms, you must not use our Platform. We reserve the right to modify these terms at any time, and your continued use of the Platform following any changes constitutes your acceptance of such changes.

2. PLATFORM PURPOSE AND SCOPE

Showboat is a professional football talent platform designed to connect players with clubs through video profiles and advanced scouting tools. Our Platform serves the football community across English, Welsh, and Scottish leagues, with plans for expansion into European and American markets. We provide specialised tools for talent showcase, scouting, and professional development within the football industry.

3. ELIGIBILITY AND ACCOUNT CREATION

3.1 General Eligibility

To use Showboat, you must be legally capable of entering into binding contracts. By creating an account, you warrant that all information provided is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Professional Verification

For clubs and scouting organisations, we require comprehensive verification of your official status. This includes providing valid documentation of your organisation’s registration, appropriate licenses, and authorisation to conduct scouting activities. All specific users from clubs will need to provide up-to-date DBS checks. Clubs will need to re-confirm their user list with Showboat annually.

4. UNDERAGE USERS AND GUARDIAN REQUIREMENTS

4.1 Mandatory Guardian Oversight

For all users under 18 years of age, parent or legal guardian involvement is mandatory. Players under 18 must have their profiles entirely managed by a parent or legal guardian. This requirement is non-negotiable and forms a fundamental part of our commitment to youth protection.

4.2 Guardian Verification Process

Upon registration of an underage player, guardians must complete our comprehensive verification process, which includes:

– Submission of valid government-issued identification or other

– Full facial recognition

– Confirmation from our verification service Veriff that verification has been complete

– Initial registration onto the platform can take place

– Access throughout the platform will then be blocked until verification is complete

4.3 Youth Profile Management

Guardians maintain complete control over underage players’ profiles, including:

– Approval of all content uploads

– Management of privacy settings

– Control of communication with clubs

– Oversight of profile visibility

5. CONTENT STANDARDS AND RESPONSIBILITIES

5.1 User-Generated Content

All content uploaded to Showboat must meet our professional standards. This includes:

– High-quality video footage of football-related activities

– Accurate and verifiable performance statistics

– Professional profile photographs

– Truthful biographical information

– Appropriate communication in all platform interactions

5.2 Content Restrictions

We prohibit:

– False or misleading information

– Inappropriate or offensive material

– Content that violates privacy rights

– Unauthorised third-party content

– Material that could compromise user safety

6. PRIVACY AND DATA PROTECTION

This privacy notice supplements the other notices and is not intended to override them.

We may ask you to provide certain data or collect certain data about you from third parties. If we are unable to process this data, you may not be able to use our services or receive the customer experience we aim to provide. The data we process may include:

Identity data – including first name, last name, username or similar identifiers

Date of birth

Photograph

Account login details

Contact data – including billing/delivery address, email address, and telephone numbers

Social media handle and public profile picture

Financial data – including payment card details

Communications between you and us and between you and third parties.

If we are concerned about the welfare or behaviour of a player we may share this information with third parties either in their vital interest, the public interest, or following other exceptions allowed under data protection law. The third parties that we would share this information with, if we do, would usually be:

Healthcare professionals such as a local authority mental healthcare team

The emergency services

We may share this data without the consent of the individual it relates to, we will ensure that this information is only shared with third parties after careful consideration of the individual’s rights. Such a decision will be made by a senior member of our management.

We may transfer your information outside the borders of the EEA while processing it.

10. How long we keep your data

We will only keep your personal data for as long as it is necessary to fulfil the purposes, we collected it for, including complying with any legal, accounting, or other reporting requirements. To decide the appropriate retention period for personal data, we consider:

Showboat Safeguarding Policy for Players Aged 17 and Under

  1. Purpose and Scope
    This safeguarding policy is designed to protect young players using the Showboat
    platform. It outlines the responsibilities of parents/guardians, clubs, and Showboat to
    ensure a safe and supportive environment for all users.
  2. Parent/Guardian Responsibilities
  • Account Management: Profiles for players aged 17 and under must be managed by a
    verified parent or guardian. This includes overseeing all content uploads and
    interactions on the platform.
  • Verification Process: Parents/guardians must undergo a verification process, providing
    identification and contact details to confirm their role.
  • Content Supervision: All content, including videos and messages, must be reviewed by
    the parent/guardian before being posted to ensure appropriateness and compliance
    with Showboat’s guidelines.

3. Club Responsibilities

  • StaH Access and Verification: Clubs must provide Showboat with a list of staH
    members who will access the platform. Each staH member must have a current DBS
    check submitted to Showboat. This will need reviewing and updating annually
  • Safeguarding Training: Clubs are responsible for ensuring that all staH members with
    access to Showboat complete regular safeguarding training to stay informed about best
    practices and legal obligations.
  • Communication Protocols: Clubs must establish clear protocols for communicating
    with underage profiles, ensuring all interactions are appropriate and professional.

4. Incident Reporting and Response

  • Immediate Action: If a club identifies a profile managed by someone other than the
    verified parent/guardian, communication must cease immediately, and the incident
    must be reported to Showboat.
  • Reporting Mechanism: Showboat provides a secure and confidential reporting system
    for any safeguarding concerns or policy breaches. Reports can be submitted
    anonymously.
  • Response Time: Showboat commits to addressing all safeguarding reports within 48
    hours, taking appropriate action to resolve issues and protect young players.

5. Data Protection and Privacy

  • Personal Data Security: Showboat ensures that all personal data of young players is
    securely stored and only accessible to authorised personnel.
  • Privacy Settings: Parents/guardians can control privacy settings to limit who can view
    the player’s profile and content, enhancing safety on the platform.

6. Continuous Monitoring and Improvement

  • Regular Audits: Showboat will conduct regular audits of the platform to ensure
    compliance with safeguarding standards and identify areas for improvement.
  • Policy Review: This policy will be reviewed annually, or more frequently if necessary, to
    incorporate new safeguarding practices and legal requirements.

7. Engagement and Education

  • Parental Guidance: Showboat will provide resources and guidance to
    parents/guardians on how to use the platform safely and eHectively.
  • Awareness Campaigns: Showboat will run awareness campaigns to educate users
    about safeguarding issues and encourage responsible platform use.

App Face Data Policy

  1. Does the app collect face data?
    • No, the app does not collect, store, or process facial images or biometric data.
    • It use Veriffs package, but it does not collect facial images in our implementation.
  2. What information is collected and why?
  • The app uses Veriff only to verify a user’s age.
  • If a user is under 18, basic identity verification data is processed to comply with our platform’s requirements.

3. How is the data stored?

    • The app does not store any verification data.
    • Any information processed for verification is securely stored by Veriff, following their privacy and security policies.

    4. How long is the data retained?

      • If a user is under 18, Veriff retains their verification data for 90 days, after which it is permanently deleted.
      • If the user is 18 or older, no data is retained.
